1 TERMS AND CONDITIONS
1.1 By visiting the e-shop eapril.com, opening or making use of the services available at this e-shop (whether via online or any other means) downloading the software associated with eapril.com you the "user" warrant and certify your understanding and acceptance of the rules, terms and conditions ("the terms and conditions") set forth below.
1.2 These terms constitute the whole of the agreement between you and eapril.com. Nothing in these terms shall exclude or limit liable for fraud or fraudulent misrepresentation.
2 GENERAL AMENDMENT

Nothing in this paragraph shall prevent the Service Providers from applying to the Courts of any jurisdiction for such provisional or protective measures as are available under the laws of that jurisdiction.
5 LIMITATION OF ACTIONS
5.1 You hereby agree that any legal proceedings to enforce any claim that you may have, if any, against eapril.com shall be initiated by you within a period of 6 (six) months of the COA arising the "prescription period" failing which you hereby forever waive and abandon any that you may have to enforce such claim after the prescribed period and confirm that on the expiry of the prescription period the said claim shall be void, waived and abandoned in law.
6 CLAIMS AND DISPUTES
6.1 No claim or dispute will be considered more than 30 days after the date of the original transaction.
6.2 In the first instance, all claims/disputes should be raised with our Customer Service Department/Quality Assurance and Managing Department. In the event of our Quality Assurance Department being unable to resolve your dispute, it may be submitted to a mutually acceptable recognized body for arbitration in India and then decision will be final so long as the full facts are presented by all of the parties concerned.
7 DATA PROTECTION AND PRIVACY
7.1 eapril.com undertakes the need to protect your privacy. All information that you provide to eapril.com will be processed and protected in accordance with the standards of level similar to those imposed by the Indian laws on the data protection (the information will be kept confidential).
7.2 By disclosing your personal information to eapril.com you consent to the collection, storage and processing of your personal information for the purposes of processing any transaction undertaken by you, for internal administration and analysis.

8.2 In no circumstances whatsoever shall eapril.com / eAnkit pvt ltd, its directors, officers, employees, shareholders, agents and affiliates, the ultimate parent/ and partner company of eapril.com and any of its subsidiaries be liable to you in contract, tout, negligence or otherwise, for any loss or damage howsoever, arising from any case whatsoever, whether direct/indirect or for any amounts whatsoever (even where we have been notified by you of the possibility of such loss or damage).
8.3 Except in the case of manifest errors or neglect on our part, eapril.com accepts no responsibility and shall not be liable for any consequences that have occurred through your use/ nuisance of our service.
9 PROMOTIONAL CAMPAIGN
9.1 It is recorded that eapril.com shall, from time to time offer sales/marketing promotions and these promotions may have separate terms and conditions that are promotion specific.
9.2 In the event of any conflict between terms and conditions and promotion specific terms and conditions, the promotion specific terms and conditions shall prevail but only to the extent that the terms and conditions conflict with one another.
10 WHOLE AGREEMENT
10.1 Unless the context otherwise indicates, these terms and conditions set out the entire agreement between us and supersede all prior oral/written agreements, arrangements or understandings between us. 11 GUARANTEE
